End User License Agreement (EULA)
Effective Date: January 1, 2024
This End User License Agreement (“EULA”) is a legally binding agreement between you (“User,” “you”) and Work Smart LLC (“Work Smart,” “SnapMug,” “we,” “us,” or “our”) governing your access to and use of the SnapMug website, mobile applications, and related services (collectively, the “App”).
By downloading, accessing, or using the App, you agree to be bound by this EULA and our Privacy Policy. If you do not agree, do not access or use the App.
1. License Grant
Subject to your compliance with this EULA, Work Smart LLC grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use.
No ownership rights are transferred to you. All rights not expressly granted are reserved by Work Smart LLC.
2. Eligibility and Account Responsibility
You must be at least 13 years old (or the minimum age required by law in your jurisdiction) to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Work Smart LLC is not responsible for unauthorized access resulting from your failure to safeguard your credentials.
3. Nature of the App
SnapMug provides tools for content sharing, discovery, community participation, and optional participation in challenges, tasks, or campaigns.
The App is provided on an “as is” and “as available” basis. Work Smart LLC does not guarantee:
- successful task completion or verification
- availability of challenges or rewards
- uninterrupted or error-free operation
4. Third-Party Platforms and Services
The App may allow you to connect with third-party platforms, including YouTube, Facebook, Instagram, and TikTok. These connections are optional and user-initiated.
Important disclaimers:
- Work Smart LLC does not control third-party platforms, their APIs, moderation decisions, or availability
- Actions performed on third-party platforms are governed by their own terms and policies
- Verification or detection of actions performed outside the App is not guaranteed
5. User Content and Conduct
You are solely responsible for any content you create, upload, post, or share through the App or on third-party platforms in connection with the App.
You agree not to:
- violate applicable laws or platform policies
- engage in fraud, abuse, or deceptive practices
- attempt to manipulate challenges, rewards, or verification systems
- interfere with the security or operation of the App
Work Smart LLC may remove content or restrict access at its discretion.
6. Challenges, Tasks, and Verification
Participation in challenges or tasks is voluntary and does not guarantee qualification, verification, or rewards.
Verification may involve proof submission, manual review, honor-based confirmation, or public signal checks. Verification outcomes may be modified or revoked due to platform limitations, content changes, or integrity checks.
Unqualified outcomes are final unless Work Smart LLC explicitly allows review.
7. Rewards (If Offered)
Rewards, if offered, are discretionary, limited, and subject to availability and eligibility rules.
Work Smart LLC does not guarantee:
- reward availability or value
- successful redemption or fulfillment
- monetary payouts unless explicitly stated
Participation does not create a contractual right to any reward.
8. Suspension and Termination
Work Smart LLC may suspend or terminate your license to use the App at any time, with or without notice, if you violate this EULA or pose a risk to the App, other users, or third parties.
Upon termination, your license immediately ends.
9. Disclaimer of Warranties
To the maximum extent permitted by law, the App is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, Work Smart LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the App.
Our total liability for any claim shall not exceed the amount you paid us (if any) in the six months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Work Smart LLC from any claims, damages, losses, liabilities, and expenses arising from your use of the App, your content, or your violation of this EULA or applicable laws.
12. Governing Law and Dispute Resolution
This EULA is governed by the laws of the jurisdiction in which Work Smart LLC is registered, without regard to conflict of law principles. Disputes shall be resolved in the appropriate courts or through binding arbitration in that jurisdiction, unless otherwise required by law.
13. Changes to this EULA
We may update this EULA from time to time. Continued use of the App after changes become effective constitutes acceptance of the revised EULA.
